These terms are the agreement between you and Cashblack Ltd, a company registered in England and Wales under company number 12785292, whose registered office is 71-75 Shelton Street, London WC2H 9JQ, when you use the CashBlack website, app or browser extension. There is no separate US company. By creating an account you accept them.
We have tried to write them so you can actually read them. Where something matters to your money, it is said plainly rather than hidden.
Your account
You must be 18 or over to hold a CashBlack account. One account per person. You are responsible for keeping your sign-in details to yourself, and for anything done on your account.
You give us a real email address that you control, because it is how we reach you about your money.
You can close your account at any time, in the app or on this website, under Settings. What happens to your information when you do is set out in our privacy notice.
How cash back works
When you start your shopping from CashBlack, we pass a tracking reference to the retailer. If the retailer accepts it, they tell us the sale happened and pay us a commission. Your cash back is a share of that commission. This is the whole mechanism, and understanding it explains most of what follows.
Cash back starts as pending. It becomes confirmed when the retailer confirms the sale, which usually takes a few weeks and sometimes longer, because retailers wait out their own returns period first. Only confirmed cash back can be cashed out.
Rates can change. The rate that applies to your purchase is the rate shown at the moment you clicked through, and we record it then so it cannot move afterwards. Orders through a delivery app work differently, and the next section explains how.
Orders through delivery apps (To Your Door)
Some restaurants on CashBlack are listed under To Your Door. You order from them through a delivery app, and CashBlack earns a commission from the delivery app rather than from the restaurant.
For these orders your cash back is half of the commission the delivery app actually pays us on your order. It is not a fixed percentage of your basket. We work it out from what the delivery app reports for that order, so we never promise you more than the order earned.
Delivery apps pay more when you are a new customer of that app than when you are a returning one. So every To Your Door listing shows two figures: the cash back for a new customer and the cash back for a returning customer, per delivery app. For example, a listing showing 2.5% for new customers and 1% for returning customers pays 2.5% of your order if the delivery app counts you as a new customer, and 1% if it counts you as a returning one.
Whether you count as new or returning is decided by the delivery app, from your history with that app, not with CashBlack. We cannot see it before you order and we cannot change it. The delivery app also decides which parts of an order it pays commission on.
The figures shown are what the delivery app pays at the time. If it pays us a different commission on your order, your cash back is still half of what it actually paid, and your pending cash back will show that amount.
When cash back does not track, and what we can do
Sometimes a purchase does not track. The usual causes are an ad blocker or privacy setting stripping the reference, using a coupon code from somewhere other than CashBlack, leaving and coming back through a different route, or the retailer simply failing to report it.
Tell us and we will chase it. We will ask the retailer or the affiliate network to find the sale and, if they do, the cash back will appear. Please keep your order confirmation, because that is what we need to make the claim.
What we cannot do is pay you cash back a retailer has not paid us. We are honest about this because the alternative is a promise we cannot keep. If a retailer refuses a claim, we will tell you they refused it rather than let it sit as pending indefinitely.
Cashing out
You can cash out once your confirmed balance reaches $10. We pay within 7 days of the request.
You give us the payout details and you are responsible for them being right. We cannot recover money sent to an account you mistyped.
If a retailer reverses a sale after we have paid you for it, which happens when an order is returned or canceled late, we will record it against your balance. It nets off against anything you earn later. We will not chase you for it, we will not email you demanding it back, and we will never show you a negative balance as a debt.
If a purchase at a CashBlack IRL event is later canceled or voided, we remove its cash back from your available balance, only as much as the balance holds, so it never goes below zero. Whatever the balance could not cover, we may take from cash back you earn later, again never going below zero, or we may write it off.
Tax
Cash back on your own purchases is generally treated as a discount rather than income, but we do not give tax advice and your situation is yours.
If your payouts in a year reach the IRS reporting threshold, federal law requires us to collect a Form W-9 from you before we can pay you any further, and to report the total. We will ask you for it in the app when you get close. If you will not provide it, we cannot pay you past that point. That is not a CashBlack policy and we cannot waive it.
CashBlack Plus
Plus is an optional membership: $5 every 28 days, paid from your cashback balance. It never touches a card, so it costs you nothing out of pocket. If your balance cannot cover a renewal, Plus pauses rather than failing, and resumes when enough confirmed cash back arrives.
You can cancel at any time and you keep Plus until the end of the period you have paid for.
Using CashBlack fairly
Do not open multiple accounts, do not use someone else's payment details, and do not place orders you intend to cancel in order to generate cash back. Do not use automated tools to click through.
If we believe an account is being used this way we may pause cash back on it while we look, and we will tell you we have done so. If we are wrong, we will put it right.
What we are not responsible for
CashBlack is not the seller. When you buy from a retailer, the contract for those goods is between you and them, and so are your rights about delivery, defects, returns and refunds. We will help you chase cash back on the order, but we cannot resolve a dispute about the goods.
We do our best to keep rates, offers and merchant details accurate, but they come from retailers and networks and can be out of date or wrong.
The service is provided as is. Nothing here limits any liability that cannot be limited under the law that applies to you.
Changing these terms
We may change these terms. If a change affects your rights or your money we will tell you before it takes effect, and you can close your account if you do not agree.
Complaints and law
If something has gone wrong, email support@cashblack.com and we will look at it properly.
These terms are governed by the law of England and Wales, because that is where the company you are contracting with is registered. This does not take away any protection you have under the consumer law of the state you live in, and you can still bring a claim where you live.
